MEMORANDUM Opinion and Order: Defendants' motion to dismiss, ECF No. 33, is granted in part and denied in part. The court partially dismisses count three of the FAC, ECF No. 19, to the extent it alleges that Obaisi is liable under a theory of supervisory liability. The court also partially dismisses count seven to the extent it seeks to impose liability under § 1983 based on respondeat superior. McDonald may amend his complaint to attach his proposed § 2-622(a) certificate, ECF No. 36-1. The amended complaint is due on or before September 27, 2017. Signed by the Honorable Joan B.
