MEMORANDUM OPINION AND ORDER signed by the Honorable Matthew F. Kennelly on 4/10/2017: For the reasons stated in the accompanying memorandum opinion and order, the Court grants defendants' motion to dismiss in part [dkt. no. 35]. Specifically, the Court dismisses count 4 as to all defendants to the extent that the claim is based on Spring's alleged confinement in the waiting room and retaliation for speaking with Alderman Burke. The Court also dismisses count 4 as to Dr. Wong and Silvestrini to the extent it is based on allegations involving drug and psychiatric testing and signing the HIPAA release form. The Court otherwise denies defendants' motion to dismiss. Given the pendency of a motion to withdraw, plaintiff's attorney is directed to take steps to immediately transmit a copy of this decision to plaintiff. (mk)
