MEMORANDUM Opinion and Order: For the foregoing reasons, Defendant's motion to dismiss, R. 10, is denied in part and granted in part. It is denied with respect to Counts I, II, III, and IV, and granted with respect to Count V. Count V is dismissed without prejudice. Should Odicho believe he can cure the deficiencies with his constructive discharge and/or defamation claims described in this opinion, he may file a motion for leave to amend those claims limited to five pages and attaching le Thomas M. Durkin on 2/27/2018:Mailed notice(srn, )the proposed amended allegations. Defendants should not respond to that motion unless the Court so orders.
