ORDER : Plaintiff's motion for leave to proceed in forma pauperis 3 is granted. The Court orders the trust fund officer at Plaintiff's place of incarceration to deduct $3.37 from Plaintiff's account for payment to the Clerk of Court as an initial partial payment of the filing fee, and to continue making monthly deductions in accordance with this order. The Clerk of Court shall send a copy of this order to the trust fund officer at Pontiac Correctional Center. However summonses shall not issue at this time. Plaintiff's motion for attorney representation 4 is granted. The Court recruits Brian J. Hickey of Cassiday Schade LLP, 2056 Westings Avenue, Suite 250, Naperville, IL 60563, to represent Plaintiff in accordance with counsels trial bar obligations under the District Court's Local Rule 83.37 (N.D. Ill.). After investigation, counsel should notify the Court by April 28, 2016, if he wishes to proceed with the complaint on file or he intends to file an amended complaint. If consistent with his obligations under Rule 11 counsel is unable to file an amended complaint, he should so inform the Court. [See STATEMENT] Signed by the Honorable Frederick J. Accordingly, it is this Court's Report and Recommendation that the plaintiffs motion be granted and that defendant Erica Barnes is dismissed form the case with prejudice. Any objection must be filed by 3/13/2018. Failure to object may constitute a waiver of objections on appeal. See Provident Bank v. Manor Steel Corp., 882 F.2d 258, 260 (7th Cir. 1989). Electronic notice (kms)ORDER Adopting Report and Recommendations: Before the court is a report and recommendation ("R&R") 77 by the magistrate judge that plaintiff's motion to dismiss 72 be granted and that defendant Erica Barnes be dismissed from the case with prejudice. After being afforded a sufficient opportunity, neither party has offered any objection to the R&R. Accordingly, there being no written objection to the R&R of the magistrate judge, see 28 U.S.C. ยง 636(b)(1); Fed. R. Civ. P. 72(b); Thomas v. Arn, 474 U.S. 140, 149-50 (1985), and the court having reviewed the R&R, the court accepts the R&R and Erica Barnes is now terminated from the case with prejudice.
