REPORT AND RECOMMENDATIONS; The Report and Recommendation dated 2/2/2018 is amended to add the following: In support of its recommendation that 18 CV 379 be reassigned based on relatedness, the Court agrees with the determination by Judge Consuelo Marshall of the Central District of California that both cases share a similarity of issues of fact or law, see Dkt. 109, Ex. C at 3-4. See Local Rule 40.4(a)(2). In addition, the Court finds that both cases are pending in this Court, reassignment is lject may constitute a waiver of objections on appeal. See Provident Bank v. Manor Steel Corp., 882 F.2d 258, 260 (7th Cir. 1989). Signed by the Honorable Iain D. ORDER Adopting Report and Recommendations: Before the court is a report and recommendation ("R&R") 118 from the magistrate judge that 18 CV 379 be reassigned based on relatedness. Accordingly, there being no written objection to the R&R, see 28 U.S.C. ยง 636(b)(1); Fed. R. Civ. P. 72(b); Thomas v. Arn, 474 U.S. 140, 149-50 (1985), and the court having reviewed the record and the R&R, the court accepts the R&R and finds that 18 CV 379 and this case are related and that 18 CV 379 should be reassigned from the Eastern Division to Judge Kapala in the Western Division. A copy of this finding will be forwarded to the Executive Committee together with a request that the Committee reassign 18 CV 379 from the Eastern Division to Judge Kapala in the Western Division.
