MEMORANDUM OPINION AND ORDER FOLLOWING BENCH TRIAL: Based on the foregoing, Patton has failed to show by a preponderance of the evidence that he is disabled within the definition of the relevant policy. Consequently, he has failed to satisfy his burden of proof. Accordingly, judgment shall be entered in favor of the defendant, MFS/Sun Life Financial Distributors, Inc., f/k/a Sun Life Assurance Company of Canada, and against the plaintiff, Michael Patton.
