Defendants' Motion to Dismiss Counts I and II in their entirety is denied. Bingham's request for qualified immunity is denied without prejudice. Plaintiff is ordered to file an affidavit setting forth the specific factual basis underlying the claims alleged in Counts I and II within 14 days of the entry of this order. ENTRY granting deft's 52 Motion for Leave to File Belated Trial Preparation Materials. The court will accommodate, and will expect defense counsel to accommodate, any reasonable requests by plaintiff's counsel for flexibility on deadlines in the final trial preparation caused by the late defense filings.
