ENTRY ON DEFENDANTS MOTION TO DISMISS OR IN THE ALTERNATIVE FOR SUMMARY JUDGMENT and PLAINTIFFS MOTION TO CERTIFY CASE AS CLASS ACTION. Although Plaintiffs individual claims for relief are moot, the court finds Plaintiff has standing to represent the class in this action (see Entry). The court further finds Plaintiff satisfies the requirements for class certification imposed by Rule 23.
