ORDER granting in part and denying in part 40 Motion for Summary Judgment. The motion for summary judgement is granted with respect to the claims against Dr. Mitcheff and denied as to the claims against Dr. Person. No partial final judgment shall issue as to the claims resolved in this Entry. A trial date will be set through a separate order. The Court sua sponte reconsiders its previous ruling denying the plaintiff's motion to appoint counsel and finds that counsel would be beneficial to assist with trial.
