ORDER-ALU'S motion for partial summary judgment on that issue 35 is GRANTED. In addition, as acknowledged by the parties during oral argument, the Defendant's motion for sanctions 73 and motion to bar Mr. McFreen from relying upon certain documents 97 were mooted by the extension of the discovery deadline in the case, and accordingly those motions are DENIED AS MOOT, as is a related motion to file a surreply 90.
