ENTRY ON DEFENDANT'S MOTION FOR LEAVE TO FILE AMENDED COUNTERCLAIM: For the reasons set forth above, the Court finds that good cause exists and justice requires amendment in this instance. Accordingly, the Court GRANTS IN PART AND DENIES IN PART Hattenhauer's Motion for Leave to Amend Counterclaim. The Court orders Hattenhauer to refile its Amended Counterclaim consistent with this Entry, deleting the "breached the covenant of good faith and fair dealing" language in paragraph 51. The Court also requests that Hattenhauer fix the graphic in paragraph 9 so as to reflect the definition of "Gross Sales" found in the franchise agreements ***SEE ENTRY FOR ADDITIONAL INFORAMATION***.
