ORDER denying Defendant's 47 Motion for Summary Judgment; granting Plaintiff's 102 Motion for Leave to File Surreply; denying Plaintiff's 108 Motion for Rule 56(d) Relief (Verified); granting Plaintiff's 133 Motion for Leave to File Oversized Brief. Defendants assert that the City of Indianapolis is not a proper defendant in this case. If this is so, it is unclear to the Court why the City did not move for summary judgment on that ground.
