ENTRY ON MOTION FOR SUMMARY JUDGMENT - Roche's Motion for Summary Judgment (Filing No. 57) is GRANTED in part and DENIED in part. Summary judgment is granted regarding Smalley's claim for punitive damages and this claim is dismissed. The Court finds that there are material disputes of fact as to whether Smalley was terminated because of her race, and whether the proffered reasons for her termination were pretext for discrimination, therefore, summary judgment is denied and this claim remains pending for trial.
