ORDER granting 50 Motion for Summary Judgment - Due to Mr. Kraemer's failure to provide expert testimony regarding the standard of care for his informed consent claim and expert testimony establishing the requisite causal connection for the same, the VA is entitled to summary judgment on his claim. As such, the Court need not analyze this case under each element of the five part test for informed consent set forth by Spar, 907 N.E.2d at 979-80.
