ORDER granting Defendant's 42 Motion for Summary Judgment. Because no genuine disputes of material fact exist and because the Plaintiff has failed to produce evidence upon which a reasonable jury could conclude that Wal-Mart breached a duty it owed to Ms. Darnell, the Court finds that Wal-Mart Stores, Inc. is entitled to judgment as a matter of law and GRANTS Plaintiff's motion.
