The Defendants are hereby further ordered to inform forthwith all other affected Indiana state governmental entities of this injunction. The Court DENIES Defendants' Cross-MotORDER - For the reasons described above, the Court GRANTS Mr. Washington's Motion to Certify a Class, 3, as modified. The Court GRANTS Mr. Washington's Motion for Summary Judgment, 31. It concludes that Indiana Code Section 34-24-1-1(a)(1), read in conjunction with Indiana Code provisions of the same chapter, violates the Due Process Clause of the Fifth and Fourteenth Amendments. The Defendants are hereby PERMANENTLY ENJOINED from enforcing Indiana Code Section 34-24-1-1(a)(1), as ion for Summary Judgment, 40. In light of this ruling, Mr. Washington's Motion for Preliminary Injunction, 5, is DENIED AS MOOT. Final Judgment shall issue accordingly. SEE ORDER. Signed by Judge Jane Magnus-Stinson on 8/18/2017.
