Entry Denying Motion for Summary Judgment on Exhaustion. For the reasons set forth in this Entry, the defendant's motion for summary judgment, Dkt. No. 18, must be denied. There are no disputed questions of fact, so there is no basis on which to set this for an evidentiary hearing. Rather, Mr. Bowling completed the grievance process and the affirmative defense of failure to exhaust administrative remedies is rejected.
