Entry Discussing Petition for Writ of Habeas Corpus and Denying Certificate of Appealability - Brian Kendrick is serving the executed portions of his 2010 Marion County convictions for attempted murder, robbery and possession of a handgun without a license. For the reasons explained in this Entry, Kendrick's petition for a writ of habeas corpus must be denied and the action dismissed with prejudice. In addition, the Court finds that pending motions should be denied and that a certificate of appealability should not issue. Kendrick's petition for a writ of habeas is therefore denied. Judgment consistent with this Entry shall now issue. The Court therefore declines to issue a certificate of appealability. (See Entry.) Signed by Judge William T. Lawrence on 4/13/2016.(RSF)
