Entry Dismissing Complaint and Directing Further Proceedings - The plaintiff's motion to proceed in forma pauperis 2 is denied as presented. The plaintiff shall have through August 11, 2016, in which to either pay the $400.00 filing fee for this action or demonstrate that he lacks the financial ability to do so. The complaint is dismissed for failure to state a claim upon which relief can be granted. However, dismissal of the complaint will not lead to a dismissal of this action at this time. Instead, the plaintiff shall have through August 11, 2016, in which to file an amended complaint. (See Entry.) Copy to Plaintiff via US Mail. Signed by Judge William T. Lawrence on 7/12/2016. (BRR)
