Entry Dismissing Action and Directing Entry of Final Judgment - Based on the foregoing, Durkin has sought relief pursuant to 28 U.S.C. ยง 2241 under circumstances which do not permit or justify the use of that remedy. This is apparent from the pleadings and the history of the sentence he now challenges. Durkin's enhanced sentence is not constitutionally infirm for the reasons he asserts. His petition for writ of habeas corpus is denied. Judgment consistent with this Entry shall now issue. SEE ORDER. Copy sent to Petitioner via US Mail. Signed by Judge William T. Lawrence on 8/8/2017.(JRB)
