ORDER granting in part and denying in part 44 Motion for Judgment on the Pleadings. See order for specifics on which claims are DISMISSED and which claims are left in tact. Within 15 days of the issuance of this order, Becker may move for leave to amend his Complaint to name presently unidentified EPD officers as Defendants and state a plausible claim for relief against the City under ยง 1983. If Becker fails to timely amend his Complaint in either respect, the Magistrate Judge will order that the corresponding claim be dismissed with prejudice and without further notice. Signed by Magistrate Judge William G. Hussmann, Jr., on 4/23/2014. (NRN) Modified on 4/23/2014 (NRN).

ORDER granting 38 Motion to Compel. The Magistrate orders the Defendants to satisfy Becker's requests by May 29, 2014. Because the deadline to complete discovery was March 1, and because this is the only discovery dispute the parties have raised, the Magistrate orders all other discovery closed at this time. The Magistrate also orders Becker to respond to the Defendants' Motion for Summary Judgment (Filing No. 26) by June 19, 2014. Signed by Magistrate Judge William G. Hussmann, Jr., on 4/29/2014. (NRN)

ORDER granting in part and denying in part 80 Motion for Summary Judgment. The court grants the motion to the extent that Becker may not hold Elfreich liable under Counts IV or VI of the Amended Complaint for unleashing Axel with instructions to bite and hold him; Becker may not hold the City liable under Count VI on the theory that deficiencies in SOP 359.00 caused injuries he sustained as a consequence of being bitten by Axel; and Becker may not hold the City liable under Count V for failing "to establish a policy that ensured the K-9 would not engage (bite) suspects if the suspect was not resisting, fleeing or endangering the safety of an officer or the public." The court denies the motion in all other respects, leaving claims in tact as directed in this order. SEE ORDER FOR FURTHER DETAILS. Signed by Magistrate Judge William G. Hussmann, Jr., on 1/26/2015. ORDER ON (1) DEFENDANTS' OBJECTION TO PLAINTIFF'S AMENDED EXHIBIT LIST AND (2) PLAINTIFF'S MOTION IN LIMINE - Because this information could be unfairly prejudicial to Mr. Becker and may not be relevant to the issues at trial, the Court GRANTS Mr. Becker's Motion in Limine 208. The Defendants are ordered to refrain from eliciting any testimony from Ms. Riddle regarding any prior acts of violence by Mr. Becker against Ms. Riddle, Ms. Riddle's husband, or Mr. Becker's mother; Mr. Becker's mother's alleged fear of Mr. Becker; and Mr. Becker's alleged abuse of alcohol unless the Defendants first establish relevancy and admissibility of such testimony outside the presence of the jury.
