ORDER denying 157 Motion for Return of Personal Property - For the reasons stated above, the Court DENIES Justin Tingle's Motion for Return of Personal Property. (Filing No. 157.) Justin's Motion is premature under 21 U.S.C. § 853(n) and Fed. R. Crim. P. 32.2, but may be raised if an order of forfeiture is issued and the Government gives notice of its intent to dispose of the property. In addition, Justin's Motion under Fed. R. Crim. P. 41(g) is DENIED because Justin has not provided sufficient evidence to show that the firearms were unlawfully seized. The clerks is ordered to add Justin Tingle as an interested party in this matter. Justin Tingle may renew his motion following the hearing on March 9, 2017, if in fact an order of forfeiture is granted on behalf of the Government. Copy sent to Justin Tingle via US Mail. ORDER SETTING HEARING ON DEFENDANT'S OBJECTIONS AND MOTION TO STRIKE APPLICATION OF 21 U.S.C. 851 in case as to RONALD TINGLE (1) - The Court DENIES in part, 165 Motion to Strike on the basis that the Information pursuant to 21 U.S.C. § 851 is unconstitutional on its face or in violation of Department of Justice policy. Tingle's remaining claims will be heard on 3/9/2017 at 2:00 PM (Eastern Time) in room #344, United States Courthouse, 46 E. Ohio Street, Indianapolis, Indiana before Judge Tanya Walton Pratt. Parties should make note that the hearing on Tingle's matters shall commence at 2:00 p.m. beginning with Tingle's objections and motion to strike the § 851 Information, followed by the Government's motion for forfeiture and finally, Sentencing. With respect to the forfeiture and § 851 hearing, parties shall file their witness or exhibit lists, if any, by Wednesday, March 8, 2017. See Order for details.
