MEMORANDUM AND ORDER Plaintiffs Objection to Report and Recommendation of Magistrate (doc. 80) is overruled. Accordingly, her Motion for Leave to Amend Complaint against Defendant Wal-Mart for Additional causes of action for negligent training and supervision and for punitive damages (doc. 71) is denied because she did not meet the standards of Federal Rules of Civil Procedure 15 and 16. Defendants Motion for Summary Judgment (doc. 78) also is denied because it has not shown that when the evidence is viewed in light most favorable to the nonmoving party that it is entitled to judgment as a matter of law in this negligence case. Signed by District Judge John W. Lungstrum on 07/2263. (ses)
