MEMORANDUM AND ORDER sustaining 4 Motion to Remand to State Court; Case is remanded to the District Court of Johnson County, Kansas. Aestheticare shall pay plaintiff its attorney's fees and costs expended in defending the removal litigation. The parties shall comply with D. Kan. Rule 54.2 in determining the proper award of fees and costs. If the parties are able to agree on the proper award of fees and costs, they shall file a stipulation on or before April 18, 2008. If the parties are unable to agree on the proper award of fees and costs, on or before April 25, 2008, plaintiff shall file astatement of consultation required by D. Kan. Rule 54.2 and a memorandum setting forth the factual basis for an award with supporting time records, affidavits or other evidence. On or before May 2, 2008, defendant may file a response. On or before May 9, 2008, plaintiff may file a reply. Overruling 6 Motion to Amend/Correct ; overruling 11 Motion for Leave to File; overruling 20 Motion for Leave to File.
