IT IS FURTHER ORDERED that the Memorandum And Order (Doc. #71) dated June 28, 2013 be and hereby is VACATED. IT IS FURTHER ORDERED that plaintiff's ADEA claims are DISMISSED for lack of subject matter jurisdiction because plaintiff failed to exhaust his administrative remedies before filing suit.
