REPORT AND RECOMMENDATIONS that the Plaintiff's Motion for Summary Judgment DE # 22, be DENIED; the Defendan's Motion for Summary Judgment DE # 20 be GRANTED as to the issue of liability, and this matter be dismissed. In the alternative, if the District Court rejects the undersigned's recommendations regarding liability, it is recommended that the Defendant's Motion for Summary Judgment on the issues of "regular use" and comparative fault both be DENIED. Objections to Report and Recommendation must be filed within 10 days from the date of service thereof or further appeal is waived. General objections or objections that require a judge's interpretation are insufficient to preserve the right to appeal.
