REPORT AND RECOMMENDATIONS as to Marocko D. Conley: 1) Violation 1 of the 10/12/2017 Report be DISMISSED; 2) Defendant be found to have VIOLATED his supervised release as set out in Violations 2 and 3 of the 10/12/2017 Report; 3) Defendant's supervised release be REVOKED; 4) Defendant be sentenced to the custody of the Atty General for 13 months, credit for time served, with no supervised release to follow; 5) the Court recommend the BOP place defendant at a facility closest to his home in Newport, Ky; 6) Defendant having preserved his right to allocution, absent Defendant filing a waiver within 14 days, he should be given the opportunity to allocute before the District Judge. Conley: 1) The Magistrate Judges R&R 146 is ADOPTED as the findings of fact and conclusions of law of the Court; 2) Defendant is found to have VIOLATED the terms of his supervised release as set out in Violations 2 and 3 of the 10/12/2017 Supervised Release Violation Report; 3) Violation 1 of the 10/12/2017 Supervised Release Violation Report is DISMISSED; 4) Defendants supervised release is REVOKED;5) Defendant is sentenced to the CUSTODY of the Attorney General for aperiod of 13 months, credit to be given for time served since his detention onthe charged violations, with no term of supervised release to follow;6) Defendants confinement shall be served, if feasible, at the BOP approved facility closes to the Defendants home in Newport, Kentucky; 7) A Judgment shall be entered concurrently.
