OPINION AND ORDER: 1) BellSouth's Motion for Summary Judgment 32 is GRANTED 2) matter is remanded to the PSC to determine the amount of damages, if any, owed as a result of the unlawful order 3) PSC's Cross Motion for Summary Judgment 49 is DENIED 4) Southeast's Cross Motion for Summary Judgment 53 is DENIED 5) BellSouth's Motion to dismiss Counterclaims is GRANTED in part and DENIED in part. Southeast's Counterclaim alleging independent violation of 201 and 202 is STAYED pending resolution by the FCC. Within 30 days of entry of this Order, Southeast shall file a status report advising the Court of its intentions regarding this particular Counterclaim. All remaining Counterclaims are DISMISSED. .
