MEMORANDUM OPINION & ORDER: 1. The Defendants' Motion to Dismiss, or in the Alternative, Motion for Summary Judgment [R. 14] is CONSTRUED as a motion for summary judgment pursuant to Rule 56; 2. The Defendants' construed motion for summary judgment [R. 14] is GRANTED; 3. The Defendants' Motion for Leave to File Excess Pages [R. 22] is GRANTED; 4.
