MEMORANDUM OPINION & ORDER, Dft's 60 MOTION to Compel discovery is GRANTED IN PART and DENIED IN PART as follows: (1) Hotwork directed to supplement answer to Int No 1 only for purposes of providing dfts w/ source of total sales numbers used to reach conclusion that dfts underpaid franchise royalties; (2) Hotwork directed to supplement answer to Int No 3; (3) Hotwork need not supplement answer to Int No 6; (4) Hotwork directed to supplement answer to Int No 7; (5) Dft's motion to compel Hotwork to produce additional docs responsive to Doc Req No 13 is DENIED AS MOOT; (6) Dft's motion to compel Hotwork to produce additional docs responsive to Doc Req No 17 is DENIED AS MOOT; (7) Hotwork directed to identify docs produced by indicating which docs respond to which requests; (8) Dfts motion to compel continuation of Hotwork's Rule 30(b)(6) depo is DENIED; (9) Email from I. Cobane to M. Hartley on 10/24/06 was not privileged communication and thus no waiver of att/client privilege; (10) Hotwork directed to provide supplemental discovery responses to dfts within 10 days.
