MEMORANDUM OPINION & ORDER: (1) Pla's 9 MOTION to Remand is DENIED; (2)the portion of the Court's preliminary scheduling order 7, which required parties to confer & file proposed briefing schedule is STRICKEN AND HELD FOR NAUGHT; (3)Pla, by counsel, has 60 days to file his memorandum in opposition to Administrator's decision; (4)Dft, by counsel, has 30 days from receipt of Pla's opposing memorandum to file its supporting memorandum; (5)Pla, by counsel, has 15 days after filing of dft's memorandum to file a reply, at which time the Clerk to submit the record for the Court's consideration.
