MEMORANDUM OPINION & ORDER (1) Dft Lawhun's Motion to Dismiss 5 is GRANTED; (2) As to Dft Lawhun, Plf's claims for breach of contract (Count 1), violation of the Kentucky Unfair Claims Settlement Practice Act (Count II), and bad faith (Count III), and outrageoud conduct (Count IV) are DISMISSED WITH PREJUDICE and Plf's claims for fraud, deceit, and misrepresentation (Count V) and punitive damages (Count VI) are DISMISSED WITHOUT PREJUDICE; and (3) as to the remaining dfts, Plf shall SHOW CAUSE on or before 6/6/08, why his claims for bad faith (Count III) and outrageous conduct (Count IV) should not be dismissed with prejudice an his claims for fraud, deceit, and misrepresentation (Count V) should not be dismissed without prejudice..
