OPINION AND ORDER: A) 42 MOTION for Summary Judgment is GRANTED in part and DENIED in part as follows: 1) GRANTED as to all claims against Justin Crockett and Larry Oakley and all claims against those dfts are DISMISSED. 2) GRANTED as to constitutional claim against Avon Garrison and Jerry Schultz and those claims are DISMISSED. 3) GRANTED as to the claim of intentional infliction of emotional distress and that claim is DISMISSED. 4) GRANTED as to the claims of negligence, negligence per se and gross negligence against the county and those claims are DISMISSED. 5) GRANTED as the claim of negligence per se against Eric Jones, Avon Garrison, Jerry Schultz and those claims are DISMISSED.
