MEMORANDUM OPINION & ORDER: 1. The motion to dismiss filed by the dfts 14 is GRANTED in part and DENIED in part. 2. Plaintiff's claims under the Due Process Clause and Eight Amendment are DISMISSED with prejudice. 3. Plaintiff's claims against Officers Voll and Chelf in their official capacity are DISMISSED with prejudice. 4. Plaintiff's claims for intentional infliction of emotional distress and negligent infliction of emotional distress claims against all Defendants are DISMISSED with prejudice. 5.
