MEMORANDUM OPINION & ORDER: 1. Defendant MetLife's 39 motion for judgment is GRANTED; 2. plaintiff's 40 motion for judgment against Defendant MetLife is DENIED. 3. Defendant American Water's 41 motion for summary judgment is GRANTED in part and DENIED in part, as outlined in Section IV of this Memorandum Opinion and Order. A penalty in the amount of $6,615.00, is assessed against Defendant American Water. 4. plaintiff's 40 motion for summary judgment against Defendant American Water is GRANTED, in part, and DENIED, in part, as outlined in Section IV of this Memorandum Opinion and Order. 5.
