RECOMMENDED DISPOSITION: For all the reasons as stated in this decision, the Court RECOMMENDS that: 1) District Court DENY 2255 Motion 174; 2) Should Harding make a motion under 28 2253, the District Court refuse a Certificate of Appealability as to all issues.
