REPORT AND RECOMMENDATIONS: The ALJ's decision is supported by substantial evidence and should be affirmed. IT IS RECOMMENDED that: 1. The Commissioner's decision be found to be supported by substantial evidence and therefore affirmed; 2. Plaintiffs Motion for Summary Judgment (R. 11) be denied; 3. Defendant's Motion for Summary Judgment (R. 12) be granted; and, 4. Judgment be entered and this matter be stricken from the active docket of the Court. Specific objections to this Report and Recommendation must be filed within fourteen (14) days of the date of service or further appeal is waived.
