MEMORANDUM OPINION & ORDER: 1. The defendants motion for judgment on the pleadings [Record No. 9] is GRANTED. 2. The plaintiff's KCPA and fraudulent misrepresentation claims are DISMISSED with prejudice. The plaintiffs breach of contract claim is DISMISSED, in part, with prejudice and, in part, without prejudice, as outlined in Section IV of this Memorandum Opinion and Order. 3.
