MEMORANDUM OPINION: re: Motion by pla for atty fees 17, Being persuaded by the arguments of the Commissioner re: the hourly rate for the Southern Division at Pikeville not exceed $100.00, and that only one hour should be allowed for preparation of the EAJA petition, the pla's mtn will be granted to the extent that counsel will be awarded a fee of $1,300.00 (13 hours x $100.00 per hour). The dft also requests that the fees be paid to the pla rather than counsel, but in view of the assignment executed by Mr. Noble at Docket Entry No. 17, Attachment No. 13, a direct award to counsel will be made. ORDER: In accordance with the Memorandum Opinion 20 simultaneously entered in the above-styled action, IT IS HEREBY ORDERED that the pla's motion for attorney fees under the Equal Access to Justice Act 17 is GRANTED to the extent that the pla's counsel is awarded $1,300.00 in fees (13 hours x $100.00 per hour), with said fees to be paid directly to counsel for the plaintiff.
