OPINION & ORDER: Petitioner Johnson's motion for discovery and anevidentiary hearing (DE 32) is DENIED WITHOUT PREJUDICE. The Court will address his motion as if it were part of the habeas petition itself. If the Court finds that state court's determination of claims raised in Johnson's petition were either "contrary to, or involved an unreasonable application of clearly established Federal law, as determined by the Supreme Court of the United States," or "w[ere] based on an unreasonable determination of the facts in light of the evidence presented in the State court proceeding", Johnson will be able to renew the motion at that time.
