MEMORANDUM OPINION & ORDER: (1) Dfts Dale A. Phillips and the Phillips Law Offices Motion for Summary Judgment (Doc. # 70) is hereby granted;(2) Plaf EQT Production Companys legal-malpractice claim againstDfts Dale A. Phillips and the Phillips Law Office is hereby dismissed, and the consolidated case, EQT Prod. Co. v. Phillips, 7:16-cv-164-DLB-EBA is dismissed and stricken from the Court's active docket; (3) Dfts John Keller and Vorys, Sater, Seymour and Pease, LLPs third partyclaims against Dfts Dale A. Phillips and the Phillips Law Office (Doc. # 23) are hereby dismissed; (4) Dfts John Keller and Vorys, Sater, Seymour and Pease, LLP's Motion for S/J (Doc. # 71) is hereby denied; and(5) Within twenty (20) days from the date of the entry of this MemorandumOpinion and Order , remaining parties shall file a Joint Status Report, setting forth available dates for a Final Pretrial Conference and Jury Trial, and whether they would be amenable to a court-facilitated settlement conference.
