OPINION & ORDER: 1) motion to remand (DE 4) is DENIED; 2) motion for leave to file sur-reply (DE 9) is GRANTED and Clerk SHALL FILE tendered sur-reply in record. The sur-reply is necessary because reply brief Pugh cites first time exhibits to state court complaint. The surreply explains what documents are and responds to arguments about documents made in reply brief. In resolving motion to remand, Court has also considered arguments regarding documents in Pugh's response to AIG's motion to file sur-reply; and 3) Pugh's motion for ruling (DE 13) is DENIED as moot.
