The Court DENIES Legacy's motion for summary judgment on Nautimill's claims for fraudulent misrepresentation, negligent misrepresentation, and redhibition. The Court GRANTS Legacy's motion for summary judgment on Nautimill's claims for breach of the warranty of fitness for ordinary use and breach of contract. The Court DENIES Legacy's motion for summary judgment on IMSE and Hasselman's counterclaims for lost commission on the sale of the Legacy Server and dismisses IMSE and Hasselman's counterclaims regarding damage to UTB #41440 for lack of jurisdiction, and therefore DENIES AS MOOT Legacy's motion for summary judgment on the same claim.. FINDINGS OF FACT AND CONCLUSIONS OF LAW - the Courtfinds that Nautimill is entitled to recover the following from Legacy in the amount of $240,000.00. In addition, Nautimill is entitled to recover attorney's fees. Counsel for Nautimill are hereby ORDERED to, within five days of the entry of judgment, submit to the Court a sworn affidavit detailing their fees in accordance with Local Rule 54.2.
