ORDER AND REASONS - the Court GRANTS IN PART and DENIES IN PART defendants' motion 32 to dismiss. Plaintiff's breach of contract claim is DISMISSED with prejudice to the extent that it rests on use of information in the patent applications or on conduct that occurred after December 11, 2012. Plaintiff's trade secret misappropriation claim under the Texas Uniform Trade Secrets Act is DISMISSED with prejudice. Plaintiff's claim for fraudulent inducement is DISMISSED without prejudice and with leave to amend within twenty-one (21) days of this order. The Court declines to dismiss plaintiff's other claims..
