REPORT AND RECOMMENDATIONS re 30 MOTION to Dismiss for Failure to State a Claim filed by Correct Care Recovery Solutions, 35 MOTION to Dismiss for Failure to State a Claim filed by Aramark Correctional Services, LLC, 21 Amended Complaint filed by Kirt Bobby Stone; IT IS therefore RECOMMENDED that the unopposed motions to dismiss filed by Correct Care Solutions, LLC, and Aramark Correctional Services, LLC, be GRANTED and that the claims against those defendants be DISMISSED WITHOUT PREJUDICE for failure to state a claim upon which relief can be granted. IT IS FURTHER RECOMMENDED that plaintiffs claims against Sheriff Marlin Gusman be DISMISSED WITHOUT PREJUDICE for failure to prosecute. Objections to R&R due by 7/5/2017.
