PARTIAL REPORT AND RECOMMENDATIONS : RECOMMENDED that Grandpre's 1983 claims against Nurse James, be DISMISSED WITH PREJUDICE as malicious. FURTHER RECOMMENDED that Grandpre's 1983 claims against Sheriff Newell Normand, be DISMISSED WITH PREJUDICE as frivolous and otherwise for failure to state a claim for which relief can be granted. FURTHER RECOMMENDED that Grandpre's 1983 claims of excessive force against Sergeant Berrian, Deputy McGinty, and Deputy Sill, failure to intervene against Sergeant Berrian, and failure to protect against Sergeant Lee be allowed to proceed and remain referred to the undersigned Magistrate Judge for further pretrial proceedings.
