ORDER AND REASONS granting in part and denying in part 48 Motion to Dismiss. Plaintiffs' claims against the Moving Defendants are dismissed without prejudice, except as otherwise specifically noted. The Motion is DENIED as untimely with respect to Defendant Trevor Simms. Plaintiffs are given leave to amend their complaint within 21 days of the entry of this Order to the extent that they can remedy the deficiencies outlined herein.
