PARTIAL REPORT AND RECOMMENDATIONS re 1 Complaint filed by Jacob Fay Luke, Sr. RECOMMENDED that plaintiff's claim against Officer Scott for excessive force and the claim against Amanda Mustin for interfering with plaintiff's right to counsel be allowed to proceed pending further development. FURTHER RECOMMENDED that plaintiff's claim against Lieutenant Schwausch for false arrest be dismissed with prejudice to its being asserted again until the Heck conditions are met.
