REPORT AND RECOMMENDATION For all of the foregoing reasons, it is RECOMMENDED that (1) plaintiff's motions for injunctive relief or temporary restraining order, Record Doc. 27 and 30, be DENIED, and (2) plaintiff's complaint asserting claims pursuant to 42 U.S.C. 1983 be DISMISSED WITH PREJUDICE as legally frivolous and/or for failure to state a claim under 28 U.S.C. 1915(e)(2) and 42 U.S.C. 1997e(c)(1). Because I am recommending that the complaint be dismissed as legally frivolous and/or for failure to state a claim as a screening matter pursuant to 28 U.S.C. 1915A, IT IS FURTHER RECOMMENDED that defendant's motion to dismiss, Record Doc. 25, be DISMISSED AS MOOT.
