Judge Nancy Gertner: ORDER entered. JUDGMENT as to Malden O. Battle (1), Count(s) 1-3, Sentence Imposed on counts 1-3: 76 months imprisonment to run concurrently with each other time served on violation-previously J Keeton case, see separate notes - concurrent with sentence for instant offense; 3 years SR, $300 Special Assessment. No Fine....SPECIAL CONDITIONS: 1.The defendant is reside at an RRC for the first six months of supervised release. 2.The defendant is prohibited from possessing a firearm, destructive device, or other dangerous weapon. 3.The defendant is to participate in a program for substance abuse counseling as directed by the United States Probation Office, which program may include testing, not to exceed 104 drug tests per year, to determine whether the defendant has reverted to the use of alcohol or drugs. The defendant shall be required to contribute to the costs of services for such treatment based on the ability to pay or availability of third party payment. 4.The defendant is to participate in a mental health treatment program as directed by the Probation Office. The defendant shall be required to contribute to the costs of services for such treatment based on the ability to pay or availability of third-party payment. JUDICIAL RECOMMENDATIONS: Court recommends that the defendant participate in RESTART if eligible. Note: Deft will receive credit for approximately 63 months, plus good time.
